EPA, Corps Propose Wetlands Rule to Clarify Loophole

In an attempt to clarify a loophole in existing law, the Environmental Protection Agency and the U.S. Army Corps of Engineers are proposing new rules to regulate certain wetlands activities.

The proposal, to be published shortly in the Federal Register, will clarify Section 404 of the Clean Water Act by changing the definition of dredged materials. That portion of the law deals with certain earth-moving activities associated with draining wetlands. This includes mechanized land clearing, ditching, channelization and in-stream mining.

Once published in the Federal Register, public comments will be accepted for 60 days. A pre-publication version of the proposal is available on the EPA web site at http://www.epa.gov/ow.
